These Terms of Sale govern purchases made through the SindioSPORT online store.

Please read them carefully before placing an order. By placing an order, you confirm that you have read and accepted the version of these Terms made available to you before checkout.

In these Terms:

  • “SindioSPORT”, “we”, “us” and “our” mean Sindio S.R.L.;

  • “Consumer” means a natural person acting for purposes outside their trade, business, craft or profession;

  • “Business Customer” means any customer acting for professional, commercial, wholesale, club, team, resale, distribution or other business purposes;

  • “Goods” means products offered for sale through the SindioSPORT online store;

  • “Customised Goods” means Goods made to a customer’s specifications or clearly personalised, including Goods bearing a name, number, logo, artwork, team identity, bespoke design or other customer-requested customisation.

These Terms apply to purchases made by Consumers through the online store.

Orders placed by Business Customers, including wholesale, reseller, distributor, club, team or custom-production orders, are governed by an accepted quotation, order confirmation, written agreement or other business terms expressly agreed with SindioSPORT. Section 15 also applies to Business Customers. 

Nothing in these Terms limits rights that cannot lawfully be limited or excluded.

We aim to ensure that product descriptions, photographs, colours, sizes, specifications and prices are accurate.

Product images are illustrative. Colours may differ slightly depending on screen settings, lighting and other display conditions. Minor differences of this kind do not affect the Consumer’s statutory rights where the Goods do not conform to the contract.

Goods are offered subject to availability. Adding Goods to a basket does not reserve them.

If Goods become unavailable after an order is placed, we will inform the customer as soon as reasonably possible. We will refund any amount paid for unavailable Goods without undue delay.

We may correct an obvious and recognisable error in a product description, price, promotion or availability before accepting an order. Where this affects an order, we will inform the customer and refund any amount already paid if the order cannot proceed

Prices are shown in euros and include VAT where applicable.

Delivery charges and the total price payable are shown before the order is submitted.

The delivery methods, available destinations and estimated delivery times applicable to an order are shown during checkout..

Before submitting an order, the customer can review the selected Goods, quantities, delivery information, price and payment details, and correct any input errors.

By submitting an order, the customer makes an offer to purchase the selected Goods in accordance with these Terms.

The automatic email confirming receipt of an order confirms only that we have received the order. It does not constitute acceptance of the order.

The sales contract is concluded when SindioSPORT sends an email confirming acceptance of the order or dispatch of the Goods, whichever occurs first.

SindioSPORT may decline an order only for a legitimate reason, including:

  • unavailability of Goods;

  • an obvious and recognisable error in price, product information or availability;

  • inability to obtain payment authorisation or receive payment;

  • suspected fraud, misuse or unlawful activity;

  • inability to deliver to the address provided; or

  • an order that is intended for professional, resale, wholesale or distribution purposes without a separate agreement with SindioSPORT.

If payment has been taken for an order that we decline, we will refund the relevant amount without undue delay.

Following conclusion of the contract, the customer will receive an order confirmation by email on a durable medium.

As a supplier concerned with satisfying its customers, we inform about the procedure for questions and complaints can be made via contact on the sindiosport.com website or in writing: 144 Rue Mattot, 1410 Waterloo, Belgium.

In addition to our own complaints procedure, since June 1, 2015, you can contact the Consumer Mediation Service (COD) for out-of-court consumer disputes. This service can mainly provide you with information about your rights as a consumer. If you have any complaints, you can also contact the COD. The COD will analyze your complaint and then forward it to the competent mediation body. More info on https://mediationconsommateur.be/fr.

Finally, you can also contact the EU Online Dispute Resolution Platform, at https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng =EN.

Available delivery methods, delivery charges, destinations and estimated delivery times are displayed during checkout before the customer places an order.

Delivery times are estimates unless SindioSPORT has expressly confirmed a specific delivery date.

For Consumer orders, Goods are delivered when the Consumer, or a third party designated by the Consumer other than the carrier, obtains physical possession of them. Risk of loss or damage passes to the Consumer at that time.

The customer must provide complete and accurate delivery information. SindioSPORT is not responsible for delay or failed delivery caused by inaccurate or incomplete information provided by the customer, without prejudice to mandatory Consumer rights.

If delivery is delayed or cannot be completed, we will inform the customer where reasonably possible. Nothing in these Terms affects a Consumer’s statutory remedies in the event of non-delivery or undue delay.

7.1 Withdrawal period

Subject to Section 7.6, a Consumer has the right to withdraw from a distance-sale contract within 14 days, without giving any reason.

The withdrawal period expires 14 days after the day on which the Consumer, or a third party designated by the Consumer other than the carrier, takes physical possession of the Goods.

Where an order contains multiple Goods delivered separately, the withdrawal period expires 14 days after the day on which the Consumer, or a third party designated by the Consumer other than the carrier, takes physical possession of the last Goods.

7.2 Exercising the right of withdrawal

To exercise the right of withdrawal, the Consumer must notify SindioSPORT of the decision to withdraw by an unequivocal statement before the withdrawal period expires.

7.3 Returning the Goods

The Consumer must return the Goods without undue delay and, in any event, no later than 14 days after communicating the decision to withdraw.

Unless SindioSPORT has expressly agreed to bear the return cost, the Consumer bears the direct cost of returning the Goods.

SindioSPORT may offer free return shipping from Belgium as a commercial service. Where this service is available, details of the return method will be provided during the return process. This commercial service does not limit, replace or condition the Consumer’s statutory right of withdrawal.

7.4 Reimbursement following withdrawal

If the Consumer validly withdraws from all or part of an order, we will reimburse the payments received for the withdrawn Goods.

Where the Consumer withdraws from the entire order, we will also reimburse the cost of the least expensive standard delivery method offered by SindioSPORT.

We do not reimburse additional delivery costs resulting from the Consumer’s choice of a delivery method other than the least expensive standard delivery method offered by SindioSPORT.

We will make the reimbursement without undue delay and no later than 14 days after being informed of the Consumer’s withdrawal decision. We may withhold reimbursement until we have received the returned Goods or the Consumer has supplied evidence of having sent them back, whichever occurs first.

Unless the Consumer expressly agrees otherwise, reimbursement will be made using the same means of payment used for the original transaction. The Consumer will not incur fees as a result of the reimbursement.

7.5 Handling of returned Goods

The Consumer may inspect and try the Goods to the extent reasonably necessary to establish their nature, characteristics and functioning, as would be permitted in a physical shop.

The Consumer is liable only for any diminished value of the Goods resulting from handling beyond what is necessary for that inspection and trial.

The absence of original packaging or tags does not, by itself, remove or restrict the Consumer’s statutory right of withdrawal.

7.6 Exceptions to the right of withdrawal

The right of withdrawal does not apply, to the extent permitted by applicable law, to:

  • Goods made to the Consumer’s specifications or clearly personalised;

  • sealed Goods that are not suitable for return for health-protection or hygiene reasons where the seal has been removed after delivery; and

  • any other Goods or contracts lawfully excluded from the right of withdrawal.

Where a product is Customised Goods or is subject to a lawful hygiene-related withdrawal exception, this will be clearly indicated before the order is placed.sures.

SindioSPORT may offer exchanges as a commercial service, subject to product availability.

An exchange does not limit or replace the Consumer’s right of withdrawal, legal guarantee rights or any other mandatory statutory rights.

If an exchange cannot be completed, we will inform the customer. Where the Consumer has validly exercised the right of withdrawal, reimbursement will be handled in accordance with Section 7.

SindioSPORT is liable for any lack of conformity of Goods that becomes apparent within two years of delivery, in accordance with applicable law.

Any lack of conformity that becomes apparent within that two-year period is presumed to have existed at the time of delivery, unless SindioSPORT demonstrates otherwise or unless that presumption is incompatible with the nature of the Goods or the nature of the lack of conformity.

In the event of a lack of conformity, the Consumer is entitled to have the Goods brought into conformity, free of charge, by repair or replacement, subject to the conditions and remedies provided by applicable law.

“Free of charge” includes the costs necessary to bring the Goods into conformity, including applicable shipping, labour and material costs.

The Consumer may be entitled to an appropriate price reduction or termination of the contract where the statutory conditions for those remedies are met.

If you believe that Goods are not in conformity with the contract, please contact us promptly using the contact details in Section 1 so that we can assess and handle your request. This does not limit your statutory rights.

This legal guarantee is separate from, and does not affect, any commercial guarantee that may be offered with particular Goods.

If Goods arrive damaged, incorrect, incomplete or potentially defective, please contact us promptly and provide the order number, a description of the issue and, where useful, photographs.

Customers should not continue to use Goods that may be unsafe or materially defective.

Nothing in this section limits the Consumer’s legal guarantee rights or other mandatory rights.

SindioSPORT processes personal data in accordance with its Privacy Policy.

The content of the Website, including text, branding, images, graphics, designs, logos, software and other materials, is owned by or licensed to SindioSPORT and is protected by applicable intellectual-property laws.

No Website content may be copied, reproduced, distributed, modified or used for commercial purposes without SindioSPORT’s prior written consent, except where permitted by mandatory law.

We use reasonable efforts to keep the Website available and its content up to date. However, we do not guarantee uninterrupted access, error-free operation or that all Website content is always current.

The Website may contain links to third-party websites. These links are provided for convenience only. SindioSPORT does not control and is not responsible for the content, availability or practices of third-party websites.

Nothing in this section limits SindioSPORT’s liability for obligations arising from a concluded sales contract or any liability that cannot lawfully be excluded or limited.

This section applies only to Business Customers.

Business Customer orders, including club, team, wholesale, reseller, distributor, custom-production and bulk orders, are subject to an accepted quotation, written order confirmation or separate written agreement.

Where a Business Customer provides a name, logo, trademark, design, image, artwork or other material for use on Goods, that Business Customer confirms that it has obtained all rights, licences and permissions necessary for SindioSPORT to use those materials for the agreed order.

Business Customers do not benefit from the Consumer right of withdrawal described in Section 7.

Customised, made-to-order, branded, personalised, teamwear and production Goods may not be cancelled, returned or exchanged after the Business Customer has approved the specifications or after production has started, unless SindioSPORT expressly agrees otherwise in writing.

Payment terms, delivery arrangements, production schedules, acceptance procedures and other conditions for Business Customer orders are those stated in the applicable accepted quotation, order confirmation or written agreement.

To the extent permitted by applicable law, Business Customer agreements are governed by Belgian law. Any dispute involving a Business Customer shall be submitted to the courts having jurisdiction under applicable law.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including liability for fraud, intentional misconduct, death or personal injury caused by negligence, and mandatory Consumer rights.

For Consumers, SindioSPORT’s liability is governed by applicable mandatory law.

SindioSPORT is not responsible for loss caused by an event outside its reasonable control, without prejudice to mandatory statutory rights.

SindioSPORT may update these Terms from time to time.

The version applicable to an order is the version made available to the customer and accepted at the time the order is placed.

Changes apply only to future orders. They do not retrospectively alter contracts already concluded, unless required by law or expressly agreed with the customer.

These Terms and Consumer sales contracts are governed by Belgian law.

Where a Consumer has their habitual residence in another country, that Consumer retains the protection of mandatory provisions of the law of that country where those provisions apply and cannot lawfully be derogated from by agreement.

Nothing in these Terms deprives a Consumer of the right to bring proceedings before a court having jurisdiction under mandatory applicable law.

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited only to the extent necessary. The remaining provisions remain in effect.

A failure or delay by SindioSPORT to exercise a right does not constitute a waiver of that right.

Annex 1 — Information on the right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period expires 14 days after the day on which you, or a third party designated by you other than the carrier, take physical possession of the Goods.

To exercise the right of withdrawal, you must notify:

of your decision to withdraw from the contract by an unequivocal statement, for example by letter sent by post or email. You may use the model withdrawal form below, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from the entire contract, we will reimburse all payments received from you, including the cost of the least expensive standard delivery method offered by us, without undue delay and no later than 14 days after we are informed of your decision to withdraw.

We may withhold reimbursement until we have received the Goods back or you have supplied evidence of having sent them back, whichever occurs first.

You must send back or hand over the Goods without undue delay and, in any event, no later than 14 days after you have communicated your decision to withdraw. The deadline is met if you send back the Goods before the period of 14 days has expired.

You bear the direct cost of returning the Goods, unless SindioSPORT has expressly agreed to bear that cost.

You are liable only for any diminished value of the Goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

The right of withdrawal does not apply to Goods made to your specifications or clearly personalised, or to sealed Goods that are not suitable for return for health-protection or hygiene reasons where the seal has been removed after delivery, where applicable law permits those exceptions.
